  • Unsolicited advertising, marketing, or telemarketing that violates applicable law, including Section 5 of the FTC Act (15 U.S.C. § 45), the CAN-SPAM Act (15 U.S.C. §§ 7701–7713), the Telemarketing Consumer Fraud and Abuse Prevention Act (15 U.S.C. §§ 6101–6108), the FTC Telemarketing Sales Rule (16 C.F.R. § 310), the Telephone Consumer Protection Act (47 U.S.C. § 227), FCC implementing regulations (47 C.F.R. § 64.1200 et seq.), and any applicable federal or state Do-Not-Call or calling-time restrictions.

  • Attempting to bypass, disable, or interfere with any security mechanism of the Services, or otherwise creating a security or service risk.
  • Reverse-engineering the Services for any improper purpose.
  • Conduct that could expose Nexrythm or third parties to liability, damages, or danger.
  • Launching or facilitating denial-of-service attacks or other conduct that disrupts the availability, reliability, or stability of the Services.
  • Transmitting viruses, malware, or other harmful code.
  • Processing Protected Health Information (as defined by HIPAA) through the Services without a signed Business Associate Agreement with Nexrythm, unless an applicable exception applies.
  • Transmitting material that infringes the intellectual property or other rights of third parties.
  • Transmitting libelous, defamatory, discriminatory, or otherwise harmful material.

This list is illustrative, not exhaustive. Nexrythm determines violations of this AUP in its sole, reasonable discretion and may revise this AUP at any time, with changes effective upon posting to the Nexrythm website. Continued use of the Services after a change constitutes acceptance of the revised AUP.
